TERMS & CONDITIONS

This agreement is between P R Mallick (here after “the photographer’’ photographer) and ______________ (hereafter referred to as “Client”).

1. Scope of Work:

  • This contract is for service and products related to photography shoot (hereafter “the shoot” or “the shoot”) totake the place at the following time and place.
  • Photographer and the Client both arrive for the shoot at _____________ (Time) and _____________ (Place), engagement at __–__(Time) and ____–____(Place); Haldi at __– _(Time) and ________(Place); Sangeet, Mehendi on _______at ______(Time) and  ________________ (Place); Wedding on ________at ______(Time) and  ____________ (Place); Reception on ______at  _______(Time) and ________________  (Place).
  • Photographer agrees to provide no fewer than _______________ photos for Client to view after the shoot and
    is not required to provide more than this number of images. Photographer will perform basic post-processing
    or digital image editing services on these photos where artistically necessary

2. FEES:

    • In consideration photography services to be provided by the Photographer, the Client agrees to pay a total fee of ___________________. The payment shall be made in the following manner:

     

    1. Advance Payment: The Client shall pay 15% (fifteen percent) of the Total Fee at the time of signing this Agreement. This amount is non-refundable and serves to confirm the booking and reserve the Photographer’s dates.
    2. Pre-Wedding / Engagement Payment: An additional 25% (twenty-five percent) of the Total Fee shall be paid at the time of the pre-wedding shoot or engagement function, whichever occurs first. In the event that no such function is scheduled, this 25% shall be paid at least one (1) month prior to the wedding date.
    3. If any pre-wedding or engagement or wedding event is rescheduled by the Client for any reason, the amount paid toward such event shall remain non-refundable. The event date may be rescheduled subject to Photographer’s availability, but shall not be canceled.
    4. Wedding Event Payments: 50% (fifty percent) of the Total Fee shall be paid prior to the wedding ceremony (Bride’s side) / 50% (fifty percent) of the Total Fee shall be paid prior to the reception event (Groom’s side).
    5. Final Payment (Album Delivery): The remaining 10% (ten percent) of the Total Fee shall be paid as follows:
    1. (a) If the Client selects photographs for the album within three (3) months from the date of the event, the balance shall be paid on the day of album delivery.
    2. (b)If the Client fails to select photographs within three (3) months, then the remaining 10% shall be paid on the same day the selected photographs are submitted to the Photographer.

  • 6.  General Terms: All payments, once made, are non-refundable, except at the sole discretion of the Photographer. The Photographer reserves the right to withhold delivery of any final work, including albums or edited images, until full payment has been received

3. Work Product:

  • The Photographer shall make available to the Client all captured, raw photographs and videos after 07 days of the shoot/event. The Client shall collect and take possession of the Raw Files, at their own cost and responsibility, after 07 days from the date of such availability, using their own storage device (Hard disk).
  • The Photographer shall not be obligated to retain or archive the Raw Files beyond the aforesaid period. In the event the Client fails to collect the Raw Files within such time, the Photographer shall bear no liability whatsoever for any loss, corruption, deletion, or damage to the Raw Files.
  • The Client shall provide the final selection of photographs and videos for album creation within three (3) months from the date of the event. Subject to timely receipt of such selection, the Photographer shall deliver the printed album and related final deliverables within 45 to 60 days from the date of receiving the Client’s selection. In the event the Client fails to provide the required selection within the stipulated three (3) month period, the Photographer shall be entitled to extend the delivery timeline at their sole discretion, and no specific delivery period shall thereafter be binding upon the Photographer.
  • All the photos delivered to Client are licensed for Client’s personal use only. Photos from the shoot are included in the price for the photography services.

Note: (Client understands and agrees that prints take longer for delivery and will be inspected by the photographer for quality before delivering them to client)

4. Indemnification:

  • Photographer and Client agree that the photographer is in no obligation to capture any specific moment, or pose, or person(s) during the shoot.
  • If Photographer is unable to perform the services as per the contract for any cause outside its control, Client agrees to indemnify photographer for any damage, loss, liability; however, Photographer will return in full amount of payment made by Client to Photographer in relation to this shoot.
  • Client agrees to indemnify and hold harmless to Photographer for any liability, damage, or loss related to technical failure, include data loss.
  • Client understands agrees that the Photographer is not required to maintain copies of the photos and videos more than 60 (sixty days) once they delivered to Client.
  • Client agrees to hold Photographer harmless for any personal injury, which may occur as the Client poses or works with Photographer.
  • Photographer will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preferences of

5. Duty of Client:

  • Client will obtain all the permissions which are necessary for Photographer for shoot and also for the event premises (Hotels, Reception Center, Churches, Building, and Personal Property). Client agrees that any failure to secure these permissions which results into fines to Photographer, or which prevent the Photographer from capturing the event(s), will not be the fault, liability or responsibility of the Photographer.

Exclusive Photographer:

Client agrees and understands that no other persons than Photographer can take pictures in between the setup made by Photographer. This may create interruption in Photographer’s work and violates the Photographer’s rights to take pictures during the shoot.

7. Model Release:

Photographer can be allowed to post or advertisement the client’s photos on social media only with the permission of Client. Photographer can also post the Client reviews and responses on their social media pages to highlight their work.
