TERMS & CONDITIONS

This agreement is between P R Mallick (here after “the photographer’’ photographer) and ______________ (hereafter referred to as “Client”).

1. Scope of Work:

This contract is for service and products related to photography shoot (hereafter “the shoot” or “the shoot”) totake the place at the following time and place.
Photographer and the Client both arrive for the shoot at _____________ (Time) and _____________ (Place).
Photographer agrees to provide no fewer than _______________ photos for Client to view after the shoot and
is not required to provide more than this number of images. Photographer will perform basic post-processing
or digital image editing services on these photos where artistically necessary

2. FEES:

In consideration photography services provided by the Photographer, Client agrees to pay the sum of
________. Client agrees to pay the Photographer a non-refundable initial payment which is the 40% (forty
percent) of the total price of the photography services upon signing this contract. This initial payment reserves
the Photographer’s time and it is not a retainer or a deposit. Photographer agrees to not advertise
availability of this time slot to any other potential clients. If clients cancel this shoot for any reason, the initial
payment will not be returned to client.
The outstanding payment amount must be paid in full (no longer than 7 days) after shoot only the 10% can be
remained which can be paid at the time of delivery of videos and hardcopies of photos (Wedding album and
Pen drive).

3. Work Product:

Photographer will share all the photos (all the captured pictures) with Client after the 7 days of shoot.
After Client selected the photos, the hardcopies of the selected photos (album) can be delivered in between
45-60 days.
All the photos delivered to Client are licensed for Client’s personal use only. Photos from the shoot are included
in the price for the photography services.

Note: (Client understands and agrees that prints take longer for delivery and will be inspected by the
photographer for quality before delivering them to client)

4. Indemnification:

Photographer and Client agree that the photographer is in no obligation to capture any specific moment, or
pose, or person(s) during the shoot
If Photographer is unable to perform the services as per the contract for any cause outside its control, Client
agrees to indemnify photographer for any damage, loss, liability; however, Photographer will return in full
amount of payment made by Client to Photographer in relation to this shoot
Client agrees to indemnify and hold harmless to Photographer for any liability, damage, or loss related to
technical failure, include data loss.
Client understands agrees that the Photographer is not required to maintain copies of the photos more than 60
(sixty days) once they delivered to Client.
Client agrees to hold Photographer harmless for any personal injury, which may occur as the Client poses or
works with Photographer.
Photographer will strive to present photos in a workmanlike manner but is not required to cater to specific
aesthetic preferences of Client.

5. Duty of Client:

Client will obtain all the permissions which are necessary for Photographer for shoot and also for the event
premises (Hotels, Reception Center, Churches, Building, and Personal Property). Client agrees that any failure
to secure these permissions which results into fines to Photographer, or which prevent the Photographer from
capturing the event(s), will not be the fault, liability or responsibility of the Photographer.

Exclusive Photographer:

Client agrees and understands that no other persons than Photographer can take pictures in between the setup
made by Photographer. This may create interruption in Photographer’s work and violates the Photographer’s
rights to take pictures during the shoot.

7. Model Release:

Photographer can be allowed to post or advertisement the client’s photos on social media only with the
permission of Client. Photographer can also post the Client reviews and responses on their social media pages
to highlight their work

The Wedding Clicks
